Compliance

The UK General Data Protection Regulation is a law imposed by the Data Protection Act 2018 (DPA 2018), and the UK General Data Protection Regulation (UK GDPR).

What is UK GDPR?

GDPR helped to create a standardised across the continent for how data is collected, used and protected. This meant businesses and organisations had to make some changes to ultimately become transparent to their website. All countries within the EU must comply with this law, the UK is also included in this list of countries despite no longer being part of the European Union. This law was introduced to protect the privacy of everyone located in the EU, regardless of if they are citizens or just visiting. Implemented in May 2018, GDPR replaced the 1995 Data Protection Directive 95/46/EC and included a lot of changes that tightened up Data Protection of EU users.

Why GDPR is a good thing...

GDPR might seem like another thing on your to-do list but take a look at the benefits of GDPR and why here at Motivation Digital we not only support it but we also offer to make your website GDPR compliant for you!

So... why do we love it?

To start with GDPR is a law you must follow if you are an entity established in the EU or you offer goods and services to people in EU countries (plus the UK).

GDPR means that your EU users can feel safe and protected with the enhancement in privacy laws. Users have the right to access what cookies are being used on the website they're browsing, why they're being used and what happens when they leave the website. If your website is not compliant with GDPR then you may be subject to penalty fines - to read more about GDPR and other Data Protection Laws you need to be aware about, click here.

How we made sure we are GDPR compliant...

We made the necessary checks to our own website to make sure we were compliant with GDPR, we followed a few processes to make sure this was done right.

Audits:

We conducted two audits:

  1. How we Collect and Process Data
We reviewed all of the activities conducted by Motivation Group, investigating what data we absolutely needed to collect to great a better user experience, and how this data is processed. We ensured the necessary safeguarding measures are in place to protect our users and their data.
  2. Third-Party Vendors
To assist the collaboration between our team and our users, we have Third-Party Vendors. As part of our accountability we have checked and validated the GDPR compliance of each of our Third-Party Vendors.

Terms & Conditions Update

Another part of making sure we are fully GDPR Compliant was revising our Terms of UsePrivacy Policy, and Cookie Policy. In these policies you can see what cookies we use, why we use them and how long your data is stored for.

We're here to help!

If you have any questions about GDPR please email us at [email protected]

Refund Policy

Hi.

Since Cheryl is not Amazon, and you cannot return PDFs, knowledge, or time spent, all In The Key Of Success program and product sales are final.

Let me say that again for the people in the back:

ALL SALES ARE FINAL.

No Refunds

Other than when a money-back guarantee is explicitly stated for a specific product, all sales are final, and the Company does not offer any money-back guarantees.  You recognize and agree that you shall not be entitled to a refund for any purchase under any circumstances for any reason. Please make sure your expectations for the product will be met by reading the description on the sales page, and if not, email [email protected].

Cheryl is committed to your success and is happy to work with you, at her discretion, so you get the most out of the product once you complete it.

Payment Plans

All payment plans need to be paid 100% and cannot be canceled (payment plans are not the same as subscriptions). Failure to pay what your payment plan balance will result in legal action. Payment plans are courtesy to the customers. Taking advantage of a payment plan and failing to complete the plan will result in the removal of the payment plan option. (Aka, you are screwing the people who actually need the payment plan. Don't do that.)

In The Key Of Success and CBE Music LLC ("the Company") does not process refunds. All sales are final. (Figured we should say it one more time.)

Conditional Money- Back Guarantee

Please note that this section does not apply to most In The Key Of Success products. For the sale of certain products, In The Key Of Success may provide a money-back guarantee. If there is such a guarantee, it will be obviously stated on the sales and checkout page. That money-back guarantee is governed by the following terms, except to the extent that the terms of a specific product or service provide otherwise.

With respect to any purchase that has an explicitly stated guarantee, you must request your money back within 30 days of the purchase. You may request your money back by emailing [email protected]. That email must contain information about the product you purchased, the date of the purchase, and the email and name associated with any such purchase. You must also demonstrate that you have attempted to implement the program without success (meaning, you need to have completed the course 100%, and prove your work). To meet this requirement, you must meet the specific refund requirements of that product.

Upon determining that you are entitled to a refund pursuant to this policy, the Company will promptly issue an instruction to its payment processor to issue the refund. The Company does not control its payment processor and will not be able to expedite any refunds.

If you receive a refund of any purchase through this money-back guarantee, that shall immediately terminate any and all licenses granted you to use the material provided to you under these Terms of Use or any other agreement. You shall immediately cease using the material and shall destroy all copies of the information provided to you, including without limitation: video recordings, audio recordings, forms, template documents, slide shows, membership areas, social media groups limited to paying members, and other resources.

Any customer may redeem a money-back guarantee from the Company only once regardless of how many products and/or services the customer purchases. In other words, after a customer has received a refund for any one product under this money-back guarantee, that customer shall not be entitled to a refund as to any other product or service purchased from the Company.
